IRC Section 482
Definition
A provision of the Internal Revenue Code that gives the IRS authority to reallocate income, deductions, and credits between commonly controlled businesses to prevent tax evasion or to clearly reflect income. It applies when related parties — such as a U.S. company and its foreign affiliate — engage in transactions that do not reflect arm's-length pricing. Violations can result in significant tax adjustments and penalties.
